Article I: Definition

I.I: An Executive Chicanery Order (ECO) is an action by the Executive Branch which may forcefully act upon legislation, bypass, or other actions without initial approval from Council.
I.II: The Executive Chicanery Order must be posted publicly on the SMP and Discord by either the President or Vice President

Article II: Creation

II.I: In the circumstance that an Executive Chicanery Order is to be created, both the President and Vice President must sign it, and both must approve of its creation.
II.II: In the case of a forged signature, or an Executive Chicanery Order is created without the consent of both the President and Vice President, it is rendered null
II.III: All Executive Chicanery Orders must be posted onto the official SMP page, and are to be under the flair "Presidential Decree".
II.IV: In the case that the Vice Presidency is vacant, the Speaker or Speaker Pro Tempore may be a signer of the Executive Chicanery Order.

Article III: Council Overruling

III.I: The moment an Executive Chicanery Order is created, any member of Council may call to override it (Not mandatory, and only in the case a Council member wishes to override the creation).
III.II: In the case a member of Council calls to override the Executive Chicanery Order, a vote will be placed within the Voting Chat, bypassing the waiting period. In the case of a 50%+1 vote, it will be overruled.
III.III: If an overrule vote is not placed within 48 hours of the Executive Chicanery Order going into to effect, the Order may not overruled by a 50%+1 Council vote, instead by a 2/3%+1 vote.

Article IV: General Enactment

IV.I: No Executive Chicanery Order is considered legal if not upheld on the SMP, and may not be removed by either the President or Vice President.
IV.II: Any Executive Chicanery Order must be the primary topic of any Presidential Decree post; hence, only one Executive Chicanery Order may be posted per post, and it cannot be compiled with an Emergency Decree, speech, nomination, or otherwise general Presidential post.
IV.III: The Ombudsman may investigate any Executive Chicanery Order, yet it may only be for topics in the following Article.

Article V: Exceptions

V.I: No Executive Chicanery Order shall amend, overrule, or otherwise change in any way the Constitution, or any amendments set forth upon the Constitution.
V.II: No Executive Chicanery Order may forcefully impeach an individual from any office.
V.III: No Executive Chicanery Order may forcefully place a Judiciary Sentence, override a Judiciary Sentence, or otherwise attempt to dictate a Judiciary Sentence.
V.IV: No Executive Chicanery Order may attempt to dissolve or disband Council
V.V: No Executive Chicanery Order may empower the President or Vice President.

Article VI: Enactment of the Amendment

V.I: This amendment shall go into effect upon passage by Council
