Preamble: Uh, parole good, alongside granting more reasonable punishment, as well as upping retention (if I’m banned for a month, my care for this place will plummet, letting them back in exchange for doing something is a needed improvement).
Sec I: Naming.
(a) This law is to be known as the PEA (Parole Establishment Amendment)
Sec II: Definitions
(a) Parole is to be defined as: The temporary or permanent release of a prisoner before the expiry of a sentence, on the promise of good behavior
(1) Good behavior falling under the following
(i) Compliance with all governing law
(ii) Not violating any crime
(iii) Mutual respect and care for other individuals.
(iiii) Fulfilling outlined terms within a parole agreement.’
(b) A parole request is an official document, authored by the attorney of the prisoner, outlining terms and conditions for an individual's return, under parole, requires Judge Approval.
Sec III: Contents
(a) A prisoner, whilst serving their sentence, may be given parole, yet it must occur within the following terms and conditions, in chronological order.
(1) An attorney of the prisoner (may be any counsel, not required to be the one who originally represented them in court) requests a parole request
(2) The attorney of the prisoner outlines set terms and conditions within the parole request,
(3) The Judge is given the said request, and the Judge may decide whether to sign it or not, if the Judge signs it, it is considered legally bound, hence the prisoner is to be given parole, under the terms of the parole request.
(A) This Judge is to be the judge of the original trial, or if that Justice no longer holds office, is to be considered the Chief Justice.
(4) If the Judge denies, the request may be given to the opposing counsel of the original trial, and if the opposing counsel consents to the terms, it may also be considered legally binding.
Sec IV: Repealing
(a) Council may repeal a parole request, under the case of a supermajority vote of council, alongside Vice President approval.
(b) The President may repeal a parole request, under the case of a unanimous vote of the President, Vice President, and Ombudsman.
(c) The Chief Justice may repeal a parole request, under the case of a supermajority vote amongst Justices.
(d) Any individual may hold a petition, and if a petition decides upon it, it may repeal a parole request.
(e) All of Sec IV must occur within 24 hours of approval, and for the insurance of this, all parole requests must be posted onto the official SMP, in the case of the request being approved.
Sec V: Enforcement
(a) It is the responsibility of the attorney of the prisoner to send any APPROVED parole requests (upon either Judge (Original Judge of the Trial or Chief Justice) or opposing counsel approving) to all acting Discord Moderators alongside any SMP moderator.
(b) It is the legal duty and obligation of the moderators to uphold the parole, and to follow the terms within the parole, failure to properly enforce, unjust treatment/discrimination, or any unfair actions to an individual under parole, is to be illegal, unless otherwise outlined within the parole request.
(c) If any individual, currently under parole, breaks any terms of their parole, they are to immediately see punishment, done via return to imprisonment (banning), unless the case the parole request outlining specific punishments.
Sec VI: Enactment
(a) This is to come into effect immediately.
(b) A parole request, following a private trial, under the ARCHON amendment, is to only outline terms, not contents nor the individuals which would be following the terms, only is to say the terms and conditions of the request.
(c) Parole is for one trial at a time, and does not extend to all trials or charges; every specific trial requiring another parole request.
(d) This document hereby amends the petition law to add for the use of parole, under the PEA law as an acceptable use of petitions.
